3.2.1 Third Party Rights - Introduction

Welcome to the second lesson of the third topic in this module guide - Third Party Rights! Many people may have many different kinds of rights against a fee simple. This can be of relevance not only in an exam context, but can in reality reduce the value of a fee simple. As such, a comprehensive understanding of how they work is crucial.

At the end of this section, you should be comfortable understanding how third parties can bear the benefit and burden of a number of different rights against a fee simple. This section begins by discussing notices as the primary means of protecting third party interests in registered land. Then, following on from this, there is a discussion of unregistered land and bona fide purchasers. The section then moves on to deal with restrictive covenants, easements and licences in detail.
